RULES AND CONDITIONS OF PRIZE GAMES ON FACEBOOK PAGE MELLIFERA.SI
1. General provisions
The organizer of our Facebook prize games is Bojana Vrviščar sp.,
Pacinje 37b, 2250 Ptuj, registry number: 6657389000, tax number: SI42603625 (hereinafter: organizer).
The prize draw will take place from 11/04/2023 to and including 22/04/2023 until 12:00, on the social network Facebook at the address https://www.facebook.com/mellifera.si .
The prize draw is not sponsored, endorsed, administered or in any way connected with the social network or company Facebook
All information provided by the user in the prize draw is received by the prize draw organizer.
- Terms of participation in the prize draw
Citizens of the Republic of Slovenia (natural persons) can participate in the prize draw. To participate in the prize draw, those under the age of 18 must obtain parental permission.
The rules of the prize draw determine the procedures and conditions under which participants participate in the prize draw.
The drawing of prize winners will take place on the date announced in the announcement.
Everyone who joins the Facebook page will participate in the prize draw
https://www.facebook.com/mellifera.si or are already members and have completed the instructions required by the prize draw.
The purchase of products is not a condition for participating in the prize draw.
- Course of the prize draw
The prize draw runs from a clearly defined and published date and lasts until the final date and time. The draw takes place on the date stated in the announcement of the prize draw. A record of the draw is prepared and kept at the organizer's address.
The winner can only be awarded once. The draw and results are final. They cannot be appealed.
- Raffle results and prize collection
The winner will be informed about the prize, the method and the deadline for receiving the prize, including the necessary information that he will have to provide to the organizer via the organizer's Facebook page. The winner must send the necessary information (name, surname, address, and, if necessary, e-mail address, telephone or tax number) to the organizer via a private Facebook message to the organizer or to the e-mail address info@mellifera.si no later than the date specified by the organizer. . The prize will be sent to the winner's postal address.
Upon acceptance of the prize, the winner is obliged to fill out a declaration of acceptance of the prize. If the prize is sent by mail, the receipt of delivery shall be considered as a declaration of receipt of the prize.
In the event that the winner does not provide the required information within the 7-day period, it is considered that he renounces the prize. In this case, this prize is not awarded, and the organizer is released from all obligations that it has towards the winner based on these rules.
- Taxes on prizes
For prize winners, the value of the prize above EUR 42.00 is included in the annual tax base for income tax assessment. Prize winnings in excess of EUR 42.00 are taxed in accordance with ZDoh-2 at a rate of 25% of the gross value of the winnings, calculated using the withholding tax coefficient. The income tax advance is paid by the organizer. Withholding tax is deducted simultaneously with the calculation of other income in accordance with the applicable regulations. Any other tax obligations are borne by the winners.
If the raffle winner is a minor, the tax number is provided by the parent or legal representative who claims income tax relief for the minor and also collects the prize for him. If the winner does not provide the information by the deadline stated in the organizer's invitation, it is considered that he does not want to accept the prize and it will not be awarded to him.
- Responsibility
The organizer bears no responsibility, nor does it take part in disputes regarding the ownership of drawn prizes. Any disputes related to the rights surrounding the ownership of the drawn prizes will have no effect on the rule that the organizer awards the prize to the person who has sent his information to the organizer in accordance with these rules. In accordance with the rules, the organizer will hand over the prize to the person of the user or to its officially authorized person, whose data will be provided in the email that the organizer receives from the awardee.
The organizer does not assume any responsibility for any damage that may occur as a result of receiving and using the prize, to which the participants expressly agree by joining this prize draw. The organizer assumes no responsibility for non-functioning of the Facebook social network and the consequences of non-functioning, regardless of the reasons for non-functioning. The organizer does not assume any responsibility for non-functioning or incomplete functioning of the participant's e-mail and Internet connection or non-functioning of the service, which is the result of incorrect use or ignorance of the use of services. In case of circumstances beyond the organizer's control (force majeure), the organizer may cancel the prize draw. He must inform the participants about this through the media. In such a case, the participants are not responsible for the resulting damage.
- Rules of the prize game
By participating in the prize draw, participants confirm that they are familiar with these rules and undertake to act in accordance with the rules of the prize draw. In the event of any dispute or ambiguity, these rules shall prevail over any other publication, whether in print, electronic or any other form.
The organizer reserves the right to change the rules if this is required by reasons of a technical or commercial nature or reasons on the part of the public. The organizer will inform participants about all changes and novelties of the prize game by means of posts on the Facebook page https://www.facebook.com/mellifera.si .
- Protection of personal data
The organizer, in the role of manager, will use the personal data obtained from the participants exclusively for the following purposes:
- implementation of the prize game in all aspects,
-notifying winners about the result of the draw and awarding of prizes (applies only to prizewinners),
-announcing the winners on their Facebook page.
The organizer processes and protects personal data in accordance with the applicable legislation in the field of personal data protection. When conducting the prize draw, all personal data will be protected with security measures based on the relevant recognized findings of science, technology and experience and will limit access to personal data only to qualified employees who have agreed to the appropriate confidentiality obligations. The organizer processes the data and ensures that all individual contractual processors process all personal data of the individual exclusively for the purposes of running the prize draw.
The tax number and tax identification number of the winners are kept for 5 years from the awarding of the prizes, or for as long as is required under tax legislation.
The organizer will under no circumstances pass on or disclose the obtained personal data to third parties. The obtained personal data is stored in accordance with the statutory period or until the cancellation of the storage of personal data by the participant.
